Marqeta, Inc. and its subsidiaries and affiliates (collectively, “Marqeta”, “we”, “our”, or “us”) are committed to protecting personal data that we collect and process during our application and recruitment process. This Marqeta Applicant Privacy Notice (“Notice”) describes how and when we collect, use, and share the personal data of Marqeta applicants (“applicant”, “you”, or “your”), and the rights you have in relation to that data.

Marqeta’s processing of personal data is subject to the requirements of applicable local law. To the extent this Notice conflicts with local law in your jurisdiction, local law controls.
This Notice applies only to information we handle in connection with your engagement within the application and recruitment process. It does not apply to any Marqeta websites, tools or platforms that display or reference a different privacy notice. For example, if you browse or interact with us via the Marqeta.com website, any personal data collected will be handled in accordance with our Website Privacy Notice and not this Notice.

Scope


This Notice applies to the personal data you directly provide to us and/or that we collect and process in connection with the application and recruitment process at Marqeta. For present and former applicants, the controller of your personal data is the Marqeta entity that you applied to for employment.
In addition to the generally applicable section of this Notice, to the extent there are variations within a specific market or additional information that is required to be provided under the applicable law, we have provided a local market supplemental privacy notice that is intended to be read in conjunction with this general Notice. These include the following:

Personal Data We Collect


Marqeta collects different types of personal data about applicants as part of the application and recruitment process. This personal data may include:
  • Identification Data – such as your name, alias, or preferred name, gender, photographs or videos, and date of birth.
  • Contact Details – such as your home and/or work address, telephone number, language preferences, and email address.
  • Application Data – such asuser credentials, user ID, password, authentication, and additional information you provide to us in a candidate profile or information contained on or in connection with your application(s) including data relating to any previous applications you may have made to Marqeta and/or its competitors.
  • Educational and Professional Background – such as your past and present job titles and positions, hire date, academic and professional qualifications, education history, CV/resume, military and veteran status, and any information about your educational and professional background provided by you or gathered from publicly available sources, including the Internet, that we believe is relevant to your application or a potential future application.
  • National Identifiers and Related Information – such as your national ID/passport, citizenship status, immigration status and documentation, visas, social security number, national insurance number and related information to assess your eligibility to work in the relevant country.
  • Device and Technical Information – such as information collected automatically about your computer or device through your web browser and other technology such as cookies, web beacons, or other tracking/recording tools which may include your IP addresses, device type, unique device identification numbers, and browser type.
  • Interview Information – such as information from interviews and phone-screenings you may have, information about your qualifications or experiences, details of the type of employment you are looking for, current or desired salary/benefits, willingness to relocate, or other job preferences. This may also include information about how you heard about the position you are applying for.
  • Assessment Data – such as information related to any assessment you may take as part of the interview screening process.
  • Background Check Data – such as information that may help us identify you, reference information and/or information received from background checks (where applicable, and legally allowable), including information provided by third parties.
  • Communication Data/User Content – such as information you provide when you correspond with us – for example, via phone call, email, social media, or video call. This may include feedback, photographs, or other recordings.
  • Feedback – such as your experiences applying to work at Marqeta and your opinions about the nature and quality of our applicant recruitment process.
  • Other Information You Choose to Share With Us – such as your social network accounts, hobbies, interests, and preferences.
  • Information from Third Party Sources – we may also collect personal data about you including your name, job title and information, work email address, phone number, social media networks, and address from third parties such as social media providers and third party recruiters.
  • Publicly Available Information – such as information from public sources and databases that, for example, help us verify your identity.
We may also collect certain demographic data that qualifies as sensitive personal data in certain jurisdictions, including (without limitation) race, ethnicity, sexual orientation, gender identity, pronouns, and disability, to help us understand and promote the diversity of our workforce. This information is generally collected on a voluntary basis; applicants are not required to provide this information to us unless it is necessary for Marqeta to comply with its legal obligations. For example, Marqeta may use this information to comply with anti-discrimination laws or government reporting obligations.
Typically, the personal data we process is collected from you directly and/or created in the course of your application for employment with Marqeta. In most circumstances, we will get your permission before we collect personal data about you from a third party.
If we ask you to provide any other personal data not described above, then the types of personal data we will ask you to provide and the reasons why we are asking you to provide it will be explained to you at the time of collection.

How We Use Your Personal Data


Marqeta uses the personal data that we collect for the purposes of managing our prospective employment relationship with you and for related business purposes, including:
Recruitment and Hiring
  • to process, review, and evaluate your job application
  • to assess your qualifications, experience, and suitability for the role, including analyzing your resume, portfolio, assessments, and other submitted materials
  • to maintain and correct records related to your job application, including by supplementing the personal data we have
  • to conduct background research to verify your educational and professional history
  • to proactively reach out if we believe you may be a fit for current or future roles
  • for other legitimate purposes reasonably required for Marqeta’s human resources and recruitment function
Recruitment Analytics and Improvement
  • to evaluate and improve our application and hiring practices, recruitment effectiveness, and diversity efforts
  • to ensure the integrity of the hiring process and preventing misuses of system
  • to carry out aggregated or anonymized benchmarking, reporting, and analytics
  • to enhance the applicant experience and improve our recruitment website
  • to obtain feedback on the applicant experience
  • to obtain feedback, conduct surveys, and similar initiatives aimed at understanding and improving the applicant experience and improve our website
Purposes That Have Been Authorized by You
  • to assist you with obtaining an immigration visa or work permit where requested by you and required by law
  • to communicate with you about the recruitment process and your application, including responding to inquiries and, where appropriate, informing you of other potential career opportunities at Marqeta
  • to carry out reference and background checks
Purposes Authorized by Applicable Law
  • to comply with laws and regulations (such as labor, employment, health and safety, immigration, anti-discrimination laws, and other legal obligations), including pursuant to requests from government or judicial authorities, and/or to exercise or defend our legal rights.
  • to exercise or defend our legal claims or rights
  • to prepare or submit reports or documentation as required by applicable laws and regulations
  • to protect the security, rights, property, and safety of Marqeta, our employees, applicants, users, or the public, as required or permitted by law
We will only use your personal data for the purposes for which it was collected, unless we reasonably consider that we need it for another purpose and there is a lawful basis for further processing and/or where we notify you of such other use and obtain any required consent in accordance with applicable laws.

When We Share Your Personal Data


Applicant personal data may be shared with other individuals at Marqeta, including members of the People Experience team.
We may also disclose your personal data to the following categories of recipients:
  • Affiliates: We may provide your personal data to our affiliates and subsidiaries as needed to manage your application and our prospective employment relationship.
  • Third-Party Providers: We may provide your personal data to third parties who provide services to or on behalf of Marqeta as part of the administration and management of your application and our human resources function.
  • Parties in a Corporate Transaction or Proceeding: We may share personal data with actual or prospective parties in a corporate transaction or proceeding, their representatives, and other relevant participants in, or during negotiations of, any sale, merger, acquisition, restructuring, bankruptcy, dissolution, or a change in control, divestiture, or sale involving all or a portion of Marqeta’s business or assets.
We may also disclose your personal data with your consent or when we believe that doing so is necessary to:
  • comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies;
  • seek legal advice from external lawyers and/or advice from other professionals;
  • establish, exercise, or defend against potential, threatened or actual litigation;
  • protect Marqeta, our customers, and others, for example, to prevent spam or attempts to commit fraud or to help prevent the loss of life or serious injury of anyone;
  • operate and maintain the security of our services, including to prevent or stop an attack on our computer systems or networks; and
  • protect the rights or property of ourselves or others, including enforcing our agreements, terms, and policies.

Information Retention


We retain your personal data for as long as necessary to manage your application, comply with our legal obligations, resolve disputes, enforce our agreements, and other legitimate and lawful business purposes. Because these needs can vary for the different data types and the purposes for which the data is collected and used, specific retention periods can vary significantly based on criteria such as applicant expectations or consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations. Information Security


We use reasonable and appropriate technical and organizational security measures designed to protect the personal data that we collect and process about you from unauthorized access, use, or disclosure. While the collection and processing of this information can never be guaranteed to be completely secure, we take steps to ensure that appropriate safeguards are in place to protect your personal data. For example, we implement access controls and store the data you provide in secured and controlled facilities.

International Transfers


As we operate a global business, your personal data may be transferred to, and processed in, countries other than the country in which you are a resident or where it was collected. These countries may have data protection laws that are different to the laws of your country (and, in some cases, may not be as protective). We take steps designed to ensure that the personal data we collect under this Notice is processed and protected according to the provisions of this Notice and applicable law wherever the information is located.
Residents of the European Economic Area (“EEA”), the United Kingdom (“UK”), and Switzerland should note that we may also transfer personal data from these jurisdictions and countries to other countries, some of which have not been determined by the European Commission or relevant authority to have an adequate level of data protection. This includes transfers to the United States. We also transfer personal data between the EEA and the UK as part of our business operations. EU-U.S. Data Privacy Framework and the UK Extension of the EU-U.S. Data Privacy Framework
For the purposes of transfers to the United States, with respect to HR Data (personal data that we collect for employment-related purposes and the management of our human resources function), Marqeta, Inc. participates in and complies with the EU-U.S. Data Privacy Framework and the UK Extension of the EU-U.S. Data Privacy Framework, (referred to collectively as the “DPFs”) as set forth by the U.S. Department of Commerce in relation to the processing of personal data sent from the EEA and the UK to the U.S.
Pursuant to its certification, Marqeta, Inc. has committed to adhere to the respective DPF Principles for the EU and the UK in line with the corresponding frameworks. Your Rights and Choices


We want to ensure that you have the appropriate tools at your disposal to control the information you provide to us. Depending on your state (U.S.) or country of residence, you may have certain rights under applicable privacy and data protection laws, including:
  • Right of Access: You may have the right to access and receive copies of the personal data that we hold about you, as well as information about how the data is used and shared.
  • Right of Erasure: You may have the right to require us to delete the personal data that we hold about you (for example if it is no longer necessary for the purposes for which it was originally collected and is not subject to any retention requirements).
  • Right to Object to/Opt-out of Processing: You may have the right to request that Marqeta stop processing your personal data for certain purposes.
  • Right to Rectification: You may have the right to require us to correct any inaccurate or incomplete personal data.
In some jurisdictions, you may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require the agent to provide proof that you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.
To exercise any of your rights, please contact us at privacy@marqeta.com. When contacting us about a rights request, please identify yourself and specify your request. We will consider all requests and provide our response within a reasonable period in accordance with applicable laws. We may ask you to provide additional verification information in order to assist you with your request. The additional information we may need will depend on the nature of your request. Depending on your jurisdiction and Marqeta’s basis for processing personal data, we may decline to process your request, including any request that is unreasonably repetitive or systematic, requires disproportionate technical effort, jeopardizes the privacy of others, or conflicts with our legal obligations. If we decline your request, we will notify you of our reason for declining. In some jurisdictions, you may have the right to appeal any denial of a rights request.

Supplemental Privacy Notice for California Residents


1. Introduction
This supplemental notice is intended for residents of California that qualify as a “consumer” as required by the California Consumer Privacy Act of 2018 (including as amended) (“CCPA”). Marqeta may disclose personal information obtained from an individual's interactions with our websites to our social media, advertising and analytics providers for the purposes of displaying advertisements and delivering targeted advertising on our websites and potentially across other businesses or third party websites, for data, analytics and for content personalization features. These disclosures may qualify as “sales” or “sharing” of personal information for valuable consideration or cross-context behavioral advertising.

Marqeta does not disclose personal information of individuals we know to be under the age of 16 to businesses or third parties for monetary or other valuable consideration as a “sale” of personal information or for cross-context behavioral advertising.

Once a request has been submitted, we may ask for additional information to verify your identity as well as information needed to process or understand your request. This information will only be used to fulfill your request and for compliance-related tracking purposes. These requests can also be submitted to us via an authorized agent in accordance with the requirements under the CCPA. In these cases, we will take steps to verify that the agent is authorized to act on your behalf. Typically, we require a valid power of attorney or a signed letter with your information that includes a statement of authorization for the request. We may still reach out to you in order to verify the agent’s authority to act as well as for identification purposes.
Opting out of the Sale or Sharing of Personal Information
Marqeta provides individuals with the ability to opt out of the sale or sharing of their personal information in a frictionless manner in accordance with the CCPA. If we receive and are able to process a signal from your device indicating your preference to opt out from sales or sharing of personal information, as defined by law, then we will apply that preference to personal information we collect from that device, provided that we may not be able to associate the signal to the same device if:
  • you use a different web browser or other tool to interact with us,
  • you make changes to your browser (e.g., uninstall and reinstall or certain types of upgrades) that impact our ability to associate the device with the signal your device originally sent, or
  • you clear cookies or browsing data from your browser or device in a way that impacts our ability to associate the device with the signal your device originally sent.

8. De-identified Information
As part of our processing, we may use personal information to create de-identified information that can no longer reasonably be used to infer information about, or otherwise be linked to an individual or household. Any applicable de-identified information will remain in a de-identified form and we will not attempt to re-identify the individual or household unless required or permitted by applicable law.
9. Updates
We will update this Notice from time to time to reflect changes to our information handling practices or as required by the CCPA by posting an updated version on our website. If the changes we make are material, we will provide you with prior notice and/or obtain consent (where required by applicable law) regarding such changes.

Supplemental Privacy Notice for the EEA and the UK

The provisions below supplement the generally applicable portions of the Notice and apply where the General Data Protection Regulation (the “GDPR”), the UK’s GDPR and UK Data Protection Act 2018 (referred to generally as the “UK Data Protection Law”) and other local implementing legislation apply to the processing of personal data within the EEA and UK.

4. Individual Rights
As a resident of the EEA or the UK, you have additional rights in relation to how your personal data is processed. These include:

  • A right of correction/rectification where your personal data is inaccurate or outdated
  • A right of portability and the ability to request a transfer of your personal data to another entity in a structured, commonly used and machine-readable format
  • Rights of restriction and objection around how your personal data is processed, including the right to object to direct marketing.
Where the legal basis for the processing is based on your consent, you also have a right of withdrawal and can revoke your consent at any time. Note that this will not impact any processing that has already occurred.
All rights above are subject to the limitations under the applicable law. Note that in certain cases, we may refuse to act or limit the processing as permitted by the applicable law. Although such requests are free of charge, to the extent requests are found to be excessive or repetitive, we may impose a reasonable fee or refuse to act on the request.

  • Marqeta UK Ltd (“Marqeta UK”)
  • Marqeta, Inc. (“Marqeta US”)
  • Marqeta sp. z.o.o. (“Marqeta Poland”)
To the extent that you are applying for employment with Marqeta UK or Marqeta Poland, those respective entities will manage the day-to-day obligations associated with your application as joint controllers. Marqeta UK, Marqeta Poland and Marqeta US will be responsible for ensuring that your personal data is collected in line with the applicable law and that appropriate data protection policies and controls are implemented. Marqeta US is primarily responsible for ensuring that Marqeta is compliant with applicable legislation and our internal policies in the EEA and UK. Marqeta US is also entrusted with managing individual rights requests.
Marqeta may use various processors in order to manage the employment relationship (as detailed in the When We Share Your Personal Data section in the generally applicable portion of this Notice).
